By entering or using the facilities of the Park Wilshire Improvement Association (PWIA), you acknowledge that such use carries inherent risks of injury, death, or damage to personal property. You voluntarily assume all such risks on behalf of yourself, your household members, and any minor children in your care.
You understand and agree that negligent use of a swimming pool, and negligent supervision of children in or around any pool, can be inherently dangerous. You are solely responsible for supervising your own children and any minors in your care at all times. You agree not to rely on the presence or divided attention of lifeguard staff as a substitute for your own judgment and supervision. You acknowledge that lifeguards cannot provide continuous or exclusive supervision of any individual, and you remain fully responsible for the safety and conduct of your children and guests at all times.
You agree to release and discharge PWIA, its Board, employees, contractors, and volunteers from any liability for injury, death, property damage, or loss arising from or related to your use of the facilities, or the use of the facilities by your children or any minors under your supervision, including claims based on the ordinary negligence of PWIA or its representatives.
You further agree to indemnify and hold harmless PWIA, its Board, employees, contractors, and volunteers from any claims, actions, damages, costs, or expenses arising from your actions or omissions, or those of your children or any minors under your supervision, in connection with use of the facilities.
You agree to comply with all PWIA rules, regulations, and policies as posted on the PWIA website or otherwise communicated by the Association. You understand that failure to follow these rules may result in corrective action, including restriction or denial of access to PWIA facilities.
You understand that by agreeing to this waiver, you are giving up substantial legal rights for yourself and for any minor children in your care, including rights related to injury, death, or property damage.
